Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and AI1952 ("Company," "we," "our," or "us") governing your access to and use of Bonik AI — our AI-powered F-Commerce business assistant app — and all related services (collectively, the "Service" or "App").

By downloading, installing, accessing, or using Bonik AI, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

If you are using Bonik AI on behalf of a business, organization, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms, and "you" refers to that entity.

If you do not agree with any part of these Terms, you must immediately stop using Bonik AI and uninstall it from your device.

Bonik AI is an AI-powered mobile business assistant designed specifically for F-Commerce sellers in Bangladesh. The app is developed and published by AI1952 and integrates advanced AI technologies to help sellers manage their businesses more efficiently.

Bonik AI's core features include:

• AI Post Generator — Generate Bengali sales posts, product descriptions, and marketing copy using AI
• Screenshot-to-Order Automation — Convert order screenshots into structured order entries using on-device OCR and AI
• Multi-Courier Integration — Connect and dispatch orders through supported courier services (Pathao, Steadfast, RedX, and others)
• WordPress/WooCommerce Store Sync — Connect your online store to sync orders, products, and customer data
• AI Photo Studio — AI-enhanced product photography tools
• Finance Tracker (Hishab) — Track income, expenses, and cash flow for your business
• AI Chatbot — AI-powered chat assistant for business queries and guidance
• Fraud Detection Network — Community-sourced database to help identify risky buyers

Bonik AI offers a free tier with daily usage limits, and paid subscription plans (Pro, Boss, Elite, Max) that unlock higher usage limits and additional features, as described in the app and on Google Play.

AI1952 reserves the right to modify, update, add, or discontinue any feature at any time with reasonable notice to users.

To use Bonik AI, you must meet the following eligibility requirements:

• You must be at least 13 years of age (or the minimum age required in your country to consent to digital services)
• Users between 13 and 18 must have parental or guardian consent where required by applicable law
• You must have the legal capacity to enter into a binding agreement under the laws of your jurisdiction
• You must not be located in a country or territory subject to a U.S. government embargo or designated as a "terrorist supporting" country
• You must not be on any government list of prohibited or restricted parties
• You must not have been previously suspended or permanently banned from Bonik AI for violating these Terms

By using Bonik AI, you represent and warrant that you meet all of the above eligibility requirements. AI1952 reserves the right to refuse service to anyone who does not meet these requirements.

Bonik AI requires you to create an account to access its features. When registering, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information to keep it accurate
• Use a strong, unique password and not share it with any third party
• Notify us immediately at support@bonikai.app if you suspect unauthorized access to your account

• You are solely responsible for maintaining the confidentiality of your login credentials
• You are responsible for all activities that occur under your account, whether authorized by you or not
• AI1952 is not liable for any loss resulting from unauthorized use of your account

• You may not create multiple accounts to circumvent restrictions, bans, or subscription limitations
• You may not buy, sell, transfer, or share your account or subscription with any other person
• Subscription sharing or credential sharing is strictly prohibited and may result in immediate account termination

You may delete your account at any time via Settings → Account → Delete Account within the app, or by emailing support@bonikai.app. See our Privacy Policy Section 9 for full details on what data is deleted and the timeline.

Bonik AI offers a permanently free tier with daily usage limits, and paid subscription plans (Pro, Boss, Elite, and Max) that unlock higher limits and premium features. Full feature details for each plan are available within the app and on the Google Play Store listing.

• All in-app purchases and subscriptions are processed through Google Play Billing
• By purchasing a subscription, you authorize Google Play to charge your payment method on a recurring monthly basis
• AI1952 does not directly handle or store your payment information
• All prices are displayed in Bangladeshi Taka (BDT) and include applicable taxes as determined by Google Play

• Where a free trial is offered, it will begin on the day you start the trial
• If you do not cancel before the trial ends, you will automatically be charged the subscription fee for the selected plan
• You may cancel a free trial at any time through your Google Play account before the trial period ends

• You may cancel your subscription at any time through your Google Play account → Subscriptions
• Cancellation takes effect at the end of the current billing period — you retain access to paid features until that date
• Cancelling your subscription does not automatically delete your account or data

• Refunds are governed by Google Play's refund policy
• AI1952 does not directly process refund requests — contact Google Play support for refund inquiries
• Refunds may be available within 48 hours of an initial purchase via Google Play. After this window, eligibility is at Google Play's discretion

AI1952 reserves the right to modify subscription prices at any time. We will provide at least 30 days' advance notice of any price changes via email and in-app notification. Continued use of the Service after the price change takes effect constitutes acceptance of the new price.

Bonik AI integrates large language model (LLM) APIs to provide AI-powered features including post generation, chatbot assistance, and content creation. By using these features, you agree to the following terms:

• AI-generated content is produced by third-party AI models and may not always be accurate, complete, up-to-date, or appropriate for your specific use case
• AI1952 does not guarantee the accuracy, reliability, or suitability of any AI-generated content
• You must review, verify, and edit all AI-generated content before publishing, sending, or acting on it
• AI outputs are clearly labelled within the app in compliance with the Google Play AI-Generated Content Policy

• You are responsible for all prompts and inputs you submit to AI features
• Prompts are transmitted securely to third-party AI providers to generate responses — see our Privacy Policy Section 10
• Do not include sensitive personal information (passwords, financial account numbers, government IDs) in prompts

• Bonik AI lets you scan or upload an order screenshot to convert it into a structured order entry using on-device OCR
• This conversion happens entirely on your device — the image itself is never collected, stored, or shared by AI1952 or any third party
• Only the resulting text may then be sent to an AI model for processing, exactly like text you type yourself

• You are solely responsible for how you use, publish, or share AI-generated content outside of the app
• AI1952 is not liable for any consequences arising from the use of AI-generated content, including claims of inaccuracy, defamation, copyright infringement, or regulatory non-compliance
• AI-generated content does not constitute professional advice — legal, medical, financial, or otherwise

• AI features depend on third-party API availability. AI1952 is not responsible for outages, delays, or changes caused by third-party AI services
• We reserve the right to switch AI providers, adjust AI models, or modify AI features at any time

You agree to use Bonik AI only for lawful purposes and in a manner consistent with these Terms, our Privacy Policy, applicable laws, and Google Play Developer Policies. You agree to:

• Use the Service for its intended purpose — F-Commerce business management, AI-powered content creation, order processing, and courier dispatch
• Comply with all applicable local, national, and international laws and regulations, including the Bangladesh Digital Security Act 2018
• Respect the rights and dignity of other users and third parties
• Be honest and accurate in all information you provide within the app
• Take responsibility for all content you generate, submit, or share using Bonik AI
• Maintain the security of your account credentials
• Use AI features responsibly, reviewing all AI outputs before acting on them
• Ensure that any API credentials you provide (courier APIs, WooCommerce) are accurate and that you have the authority to use them

• Generate, distribute, or promote illegal, harmful, violent, hateful, discriminatory, or sexually explicit content
• Harass, bully, threaten, stalk, or abuse any individual or group
• Impersonate any person, organization, or entity, including AI1952 staff or other sellers
• Spread misinformation, disinformation, or deliberately false content about products, prices, buyers, or sellers
• Infringe any copyright, trademark, patent, trade secret, or other intellectual property rights
• Violate the privacy of others — including collecting or sharing personal data without consent
• Send spam, unsolicited promotional messages, or bulk communications
• Conduct phishing, fraud, scams, or any deceptive practices against buyers, sellers, or third parties
• Generate content that facilitates or promotes illegal activities
• Attempt to bypass, reverse-engineer, hack, or exploit any part of our Service or security systems
• Scrape, extract, or data-mine content from the app without written authorization
• Use automated bots, scripts, or tools to interact with the Service in unauthorized ways
• Attempt to extract AI model weights, training data, or system prompts
• Use Bonik AI to develop a competing product or service
• Circumvent usage limits, subscription paywalls, or account restrictions
• Share, resell, or allow third parties to use your subscription credentials
• Use the Service in any way that violates Google Play Developer Policies
• Facilitate or assist any third party in doing any of the above

Bonik AI allows you to create, save, and manage content ("User-Generated Content" or "UGC"), including product descriptions, marketing posts, order notes, images, and AI-generated material. The following terms apply to all UGC:

• You retain ownership of original content you create and submit through Bonik AI
• AI1952 does not claim ownership over your UGC

By submitting UGC, you grant AI1952 a non-exclusive, royalty-free, worldwide license to store, display, process, and use your UGC solely for the purpose of operating, maintaining, and improving the Service. This license ends when you delete your content or your account.

• You represent and warrant that you have all necessary rights to the content you submit and that it does not violate any third-party rights or applicable laws
• You are solely responsible for all UGC you create, save, or share
• You must not submit UGC that is illegal, harmful, infringing, defamatory, obscene, or violates these Terms

• AI1952 reserves the right (but not the obligation) to review, moderate, edit, or remove any UGC that violates these Terms, without prior notice
• Repeated violations of content policies will result in account suspension or permanent termination
• If you believe content within the app infringes your rights, contact us at support@bonikai.app

Bonik AI, including its source code, design, graphics, logos, trademarks, brand names, UI elements, functionality, and all content created by AI1952 (excluding your UGC), is the exclusive intellectual property of AI1952 and is protected by copyright, trademark, and other intellectual property laws.

• The "AI1952" and "Bonik AI" names, logos, and branding are trademarks of AI1952
• You may not use AI1952 or Bonik AI trademarks without prior written permission
• You may not copy, reproduce, modify, distribute, display, sell, or create derivative works of any AI1952-owned content

AI1952 grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use Bonik AI on your personal Android device(s) solely for your personal or internal business use, subject to these Terms. This license does not include the right to:

• Sublicense, resell, or commercially exploit the app or its content
• Reverse-engineer, decompile, or disassemble the app
• Remove, alter, or obscure any proprietary notices within the app
• Create derivative works based on the app

Bonik AI incorporates third-party technologies (Firebase, AI APIs, courier APIs, etc.) that are subject to their own intellectual property terms. AI1952 does not claim ownership over third-party technology, trademarks, or content.

The ownership of AI-generated content is a complex and evolving area under current law. AI1952 does not claim ownership of content generated in response to your prompts. However, AI1952 is not responsible for any intellectual property claims arising from your use of AI-generated content.

Bonik AI integrates with and relies on third-party services to deliver AI features, analytics, crash reporting, advertising, courier dispatch, and payments. These services are governed by their own terms and privacy policies:

By using Bonik AI, you also agree to the relevant terms of these third-party providers. AI1952 is not responsible for the practices, availability, or content of third-party services.

• You are solely responsible for the accuracy of the API credentials you provide and for any actions taken through these integrations
• AI1952 is not responsible for service interruptions, data inaccuracies, or losses caused by the courier provider's or your store's own systems, downtime, or API changes
• You may disconnect any courier or store integration at any time from within the app, which immediately revokes the app's access using your stored credentials

Bonik AI's free tier may display advertisements — including optional rewarded ads you may choose to watch to unlock additional usage — through Google AdMob. Bonik AI may also run app-install marketing campaigns through the Meta (Facebook) SDK. By using Bonik AI, you agree to the following:

• Bonik AI may use your Android Advertising ID (AAID) and other device signals to serve and measure ads, and to attribute app installs to specific ad campaigns
• The Meta SDK automatically logs app events (such as install, open, and purchase events) to measure the performance of Facebook/Instagram ad campaigns, as described in our Privacy Policy Section 18
• Pro, Boss, Elite, and Max subscribers have all advertising removed from the app

• By installing and using Bonik AI's free tier, you consent to advertising identifiers and app events being shared with the respective ad platform for campaign measurement and ad delivery
• You may limit this at any time via Android Settings → Privacy → Ads → Opt out of Ads Personalization, or manage your Meta ad preferences at facebook.com/adpreferences

AI1952 does not sell your personal information to advertisers. Advertising identifiers and app events shared with Meta or AdMob do not include your name, email, prompts, or AI-generated content.

Bonik AI may generate files on your device — such as invoices, receipts, or exported order reports — and let you open or share them with other apps you choose (e.g., a PDF viewer, email, or messaging app), using Android's secure FileProvider mechanism.

• Only files that Bonik AI itself generates are made available for sharing — never your personal photos, downloads, or unrelated device files
• Access to a shared file is granted only to the specific app you select via the Android share sheet, and only for as long as needed to complete that action
• You are responsible for the destination app and what you do with a file once you choose to share it outside of Bonik AI
• These files remain on your device and are not uploaded to our servers as part of this sharing mechanism

To the maximum extent permitted by applicable law, AI1952 expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• Any warranty that the Service will be uninterrupted, error-free, secure, or free of viruses
• Any warranty regarding the accuracy, reliability, completeness, or timeliness of any content, including AI-generated content
• Any warranty that defects in the Service will be corrected
• Any warranty regarding results obtained from using the Service — including business outcomes, sales results, or courier delivery performance

AI-generated content produced by Bonik AI does not constitute professional advice of any kind — including legal, medical, financial, business, or technical advice. Always consult a qualified professional for advice specific to your situation.

AI1952 does not warrant that Bonik AI will meet your specific business requirements or that AI features will always produce accurate, appropriate, or high-quality outputs in Bengali or any other language.

To the maximum extent permitted by applicable law:

• AI1952, its directors, employees, affiliates, agents, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, revenue, data, goodwill, business opportunities, or sales arising from your use of or inability to use Bonik AI
• AI1952's total cumulative liability to you for all claims arising from or related to the Service shall not exceed the greater of (a) the amount you paid to AI1952 in the 12 months preceding the claim, or (b) USD $50
• These limitations apply regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise) and even if AI1952 has been advised of the possibility of such damages
• AI1952 is not liable for courier delivery failures, store sync errors, or any losses arising from third-party service interruptions connected through the app

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you. In such cases, AI1952's liability will be limited to the maximum extent permitted by applicable law.

You agree to indemnify, defend, and hold harmless AI1952 and its officers, directors, employees, agents, affiliates, and licensors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your use of or access to Bonik AI
• Your violation of these Terms or our Privacy Policy
• Your violation of any applicable law, regulation, or third-party rights
• Any content or prompts you submit to our AI features
• Any UGC you create, save, or share through Bonik AI
• Your misuse of AI-generated content outside of the app
• Any actions taken through your courier or store integrations
• Any dispute between you and a buyer, seller, or courier provider in connection with your use of Bonik AI

AI1952 reserves the right, at its own expense, to assume exclusive defense and control of any matter subject to indemnification by you. You agree to cooperate with our defense of such claims.

You may stop using Bonik AI and delete your account at any time via Settings → Account → Delete Account, or by emailing support@bonikai.app. Cancelling your subscription through Google Play is a separate action from deleting your account.

AI1952 reserves the right to suspend or permanently terminate your account and access to Bonik AI, with or without notice, if we determine that you have:

• Violated these Terms, our Privacy Policy, or the Acceptable Use Policy
• Engaged in fraudulent, abusive, or illegal activity
• Violated Google Play Developer Policies in a way that affects our Service
• Created risk or legal exposure for AI1952 or other users
• Shared subscription credentials or attempted to circumvent subscription limits

• Upon termination, your right to use Bonik AI immediately ceases
• You will lose access to any content saved within the app and any unused subscription period
• All courier and store integrations will be disconnected
• Sections of these Terms that by their nature should survive (including Sections 10, 14, 15, 16, 22, and 23) will continue in full force after termination
• AI1952 is not liable to you or any third party for termination of your access

Your privacy is important to us. Our collection, use, and handling of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using Bonik AI, you consent to the collection and use of your data as described in our Privacy Policy. Key points include:

• We collect usage data, crash reports, and performance metrics via Firebase (Google) to improve the app
• AI prompts are transmitted securely to third-party AI providers to generate responses
• We do not sell your personal data to third parties
• You have the right to access, correct, and delete your personal data
• You may delete your account at any time via in-app Settings or by emailing us
• Courier and store API credentials are encrypted at rest and never shared with unrelated third parties

Please review the full Privacy Policy to understand all data practices applicable to your use of Bonik AI.

Bonik AI is intended for adults and business users and is not directed at children under 13 years of age. We do not knowingly collect personal information from children under 13 (or under 16 where required by local law).

If you are a parent or guardian and you believe your child has registered for or is using Bonik AI without your consent, please contact us immediately at support@bonikai.app. We will take prompt action to investigate and, where confirmed, delete the child's account and data.

Bonik AI is distributed through the Google Play Store. By downloading or installing Bonik AI through Google Play, you also agree to the Google Play Terms of Service.

• Bonik AI should only be downloaded from the official Google Play Store listing. AI1952 is not responsible for any version of the app downloaded from unofficial or third-party sources
• Installing apps from unofficial sources is done at your own risk and may expose your device to malware or security vulnerabilities

• AI1952 is committed to full compliance with Google Play Developer Program Policies
• Bonik AI meets Google Play's Data Safety, AI Content, Account Deletion, and Advertising requirements
• Any update required to maintain Google Play compliance will be released, and you may be required to update to continue using the Service

• AI1952 may release updates to Bonik AI through Google Play. We recommend keeping the app updated to receive security patches, bug fixes, and new features
• Certain updates may be required to continue using the Service. Failing to update may result in reduced functionality or loss of access to certain features

AI1952 reserves the right to modify these Terms of Service at any time. We will notify you of material changes through:

• An in-app notification prompting you to review the updated Terms
• An email notification to your registered email address for significant changes
• Updating the "Effective Date" at the top of this page

The updated Terms will be effective immediately upon posting unless a later date is specified. Your continued use of Bonik AI after the effective date constitutes your acceptance of the revised Terms.

If you do not agree with the revised Terms, you must stop using Bonik AI and may delete your account. The most current version of these Terms is always available at bonikai.app/terms.php.

For minor changes (grammar corrections, clarifications that do not affect your rights), we may update the Terms without prior notice.

These Terms and any disputes arising out of or related to them shall be governed by and construed in accordance with the laws of Bangladesh, without regard to its conflict of law principles.

For users located in the European Union or EEA, mandatory consumer protection laws of your country of residence may apply and prevail over these Terms where they provide greater protection.

For users located in California, USA, California consumer protection laws (including CCPA) may apply in addition to these Terms.

Nothing in this section limits your rights under applicable mandatory local laws that cannot be excluded by contract.

Before initiating any formal dispute process, you agree to first contact AI1952 at support@bonikai.app and attempt to resolve the dispute informally. We will make good-faith efforts to resolve your concern within 30 days of receiving your written notice.

If informal resolution fails, disputes shall be resolved through binding arbitration under mutually agreed arbitration rules, unless prohibited by applicable law in your jurisdiction. The arbitration shall be conducted:

• In the English language
• Via written submissions or virtual hearing (no requirement for in-person attendance)
• With each party bearing its own legal costs unless the arbitrator orders otherwise

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent intellectual property infringement, unauthorized access, or other irreparable harm.

To the extent permitted by law, you agree to resolve disputes with AI1952 on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.

If any provision of these Terms is found by a court or arbitrator of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or if it cannot be so modified, it shall be severed from these Terms.

The invalidity or unenforceability of any provision shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect.

AI1952's failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision unless acknowledged and agreed to by AI1952 in writing.

These Terms of Service, together with the Bonik AI Privacy Policy and any additional terms specific to a particular feature, constitute the entire agreement between you and AI1952 regarding your use of Bonik AI.

These Terms supersede all prior agreements, understandings, negotiations, representations, and warranties — whether oral or written — between you and AI1952 concerning the Service.

Section headings in these Terms are for convenience only and have no legal effect. References to "including" mean "including without limitation."

AI1952 may assign these Terms or any rights hereunder without your consent. You may not assign these Terms or any of your rights or obligations under these Terms without AI1952's prior written consent.
